Dr. Cassiel Ato Forson’s lawyers have filed an extra affidavit to support their request for a mistrial, injunction, and/or stay of proceedings in the ongoing ambulance case.
The affidavit includes a popular recording of a phone call between Richard Jakpa (the third accused) and Attorney General Godfred Dame. The recording has evidence of criminal and prosecutorial misconduct by the AG.
The affidavit also includes quotes from media reports, especially from Asaase Radio, that show the AG’s professional misconduct. These quotes have been cited and attached to the affidavit.
Ato Forson is asking the court to declare a mistrial in the interest of justice. He emphasizes that justice must not only be done but must also be clearly seen to be done.
He claims that the Attorney General has behaved in a bad and unlawful way just to make sure he is found guilty.
Ato Forson says that if the court goes ahead with the trial despite these serious claims of misconduct, it would be a mockery of justice and make people lose faith in the legal system.
The application is set to be moved on Tuesday, June 4, 2024.
