The Office of the President has asked the Clerk of Parliament to desist from transmitting the Human Sexual Rights and Family Values Bill, 2024, to the President.
The Office of the President in a statement said their request comes as a response to two separate applications for an order of interlocutory injunction filed in the Supreme Court.
These applications, filed on March 7, 2024, in cases Dr. Amanda Odoi v. The Speaker of Parliament and the Attorney-General (J1/13/2023), and Richard Sky v. The Parliament of Ghana and The Attorney-General (J1/9/2024), respectively, seek to restrain Parliament and the President from advancing the bill until the court makes a final decision on their writs.
The Executive Secretary of the President who issued the statement said the Office was informed of these processes by a letter from the Attorney-General to the President, dated March 18, 2024.
According to Nana Bediatuo Asante the President aside being informed of the pending injunction applications was also advised by the AG against taking any further action regarding the bill until the Supreme Courts hears and rules on the two injunction applications.
“It is settled law that, during the pendency of an interlocutory injunction application, the status quo ante ought to be preserved, and no action should be taken that would result in prejudicing the injunctive relief sought and undermining the authority of the court,” the Executive Secretary to the President said.
