A High Court in Accra has adjourned proceedings in the case of Republic vs. Kenneth Nana Yaw Ofori-Atta & 7 to May 26, 2026, following fresh legal developments surrounding the prosecutorial authority of the Office of the Special Prosecutor (OSP).
At Thursday’s sitting, the prosecution informed the court that since the last adjourned date, significant proceedings had taken place both at the High Court—specifically General Jurisdiction Court 10 (Gu10)—and at the Supreme Court of Ghana, touching on the scope of the OSP’s prosecutorial mandate.
The prosecution urged the court to take judicial notice of these proceedings, adding that the OSP has filed a Notice of Appeal as well as an Application for Stay of Execution. The return date for the application has been set for May 21, 2026.
In view of these developments, the prosecution requested an adjournment of the case pending the outcome of the stay application.
Lawyers representing the accused persons present in court—excluding former Finance Minister Kenneth Nana Yaw Ofori-Atta and his former Chief of Staff, Ernest Akore—did not oppose the request. However, they urged the court to set a reasonable adjournment date to avoid repeated delays.
The court, in its ruling, acknowledged the ongoing legal processes and the pending application before higher courts.
“In the light of the decision of my learned brother sitting at Gu10 and the subsequent Notice of Appeal and Application for Stay of Execution filed by the OSP, and considering that May 21, 2026, is the return date, it is only fair to adjourn the suit to a date after that,” the presiding judge stated.
The court consequently adjourned the case to May 26, 2026.
Meanwhile, Kenneth Nana Yaw Ofori-Atta and Ernest Akore remain absent from proceedings. Both have been declared fugitives, with extradition requests reportedly initiated and summons directed at them in the United States.
The case forms part of ongoing efforts by the OSP to prosecute alleged corruption and related offences involving high-profile public officials.
