Appearing before Parliament’s Appointments Committee today, Supreme Court nominee Justice Dennis Dominic Adjei has clarified the constitutional provisions for presidential succession, emphasizing the deliberate limitations designed to ensure orderly transitions of power.
He stressed that the 1992 Constitution intentionally restricts presidential succession to three key figures, thus the President, the Vice President and the Speaker of Parliament. He explained that this limitation is rooted in a principle he termed “capping legitimacy” in legal interpretation, highlighting the necessity of clear boundaries in succession.
He further elaborated on the intent of the lawmakers, asserting that at any given point, one of the three designated successors must remain within Ghana. Justice Adjei firmly stated that this succession line cannot be extended to include the Chief Justice, “because the law does not say so.”
According to him, the constitutional framers purposefully limited the line of succession to ensure stability and predictability in governance.
