Former Board Chair and owner of defunct microfinance company Obaatanpa Seth Obugyei is relying on “confrontation” as evidence that he personally returned a GHC500, 000 loan to former Chief Executive of the Microfinance and Small Loans Center (MASLOC).
Mrs. Sedina Tamakloe Attionu has vehemently denied his allegation.
Seth Obugyei who is the key witness in the Obaatanpa leg of the case against the former MASLOC CEO, has been under cross-examination.
Both Seth Obugyei and Sedina Tamakloe Attionu appeared before EOCO over the claim by the former that he returned the loan amount in cash to the latter. Mr. Obugyei claimed his management had decided the loan be returned after they considered the terms unfavourable.
Seth Obugyei told an Accra High Court presided over by Justice Afia Serwaa Botwe that investigators at EOCO arranged a meeting with former MASLOC Boss to confront him over the allegation.
He was of the opinion that the fact that Mrs. Sedina Tamakloe Attionu declined comment on the matter at the meeting is adequate evidence that she actually received the cash.
The former Obaatanpa Board Chair’s claim is however contrary to the evidence available to the court.
Lawyer Agbesi Dzakpasu who was cross-examining Seth Obugyei pointed out that Mrs. Tamakloe Attionu decision not to comment was based on his advice as her counsel.
This was because he did not see the value a confrontation at the office of EOCO would have in a court of law.
Evidence before the court shows that Mrs. Tamakloe Attionu sharply denied the allegation in all her written statements during her visits to EOCO.
Confrontations are not admissible evidence in any court of law.
Seth Obugyei however believes it should count in establishing the allegation against the former MASLOC Boss.
