Former Member of Parliament for Tamale Central Alhaji Inusah Fuseini has described as ‘funny’ the Attorney General Godfred Yeboah Dame’s insistence that Justice Clemence Honyenuga continue to superintend over the case against former CEO of COCOBOD Dr. Stephen Opuni and businessman Seidu Agongo.
The Supreme Court by a 4:3 majority decision held the opinion that Justice Honyenuga can continue to handle the matter despite the allegations of bias raised against the Supreme Court Judge by the accused persons.
The Supreme Court by its latest decision overturns its earlier 3:2 majority position that Justice Clemence Honyenuga’s could not continue as the presiding judge in the matter.
Former Tamale Central MP Alhaji Inusah Fuseini says the AG should not have sort a review of the court’s decision as the accused persons were entitled to a fair trial.
Speaking in an interview with Sena Nombo on the Gold Power Drive said the move amounted to the AG treating the matter as if it was his ‘private affair’.
The former Tamale Central MP who is a lawyer by profession said the AG demonstrated a misunderstanding of his role considering the fact that he had a Minister for Justice attached to his designation.
Alhaji Inusah Fuseini said the AG needed to learn from his colleagues in other jurisdictions who understood that their roles were bigger that their personal egos or opinions adding that an AG does not appeal or seek the review of a decision because he disagreed with it.
He said the AG also had the duty to protect and defend an accused person’s right to a fair trial.
The Supreme Court’s latest decision was at the behest of Godfred Yeboah Dame who insisted on Justice Honyenuga continuing to handle the matter when he filed an application for a review of the court’s earlier decision.
Coincidentally, the two judges added to the original Supreme Court panel to make up the Review panel, Justices Prof. Nii Ashie Kotey and Gertrude Torkornoo held the opinion that the allegations of bias notwithstanding, Justice Clemence Honyenuga can continue to handle the matter.
Dr. Stephen Opuni and Seidu Agongo had accused Justice Honyenuga of prejudging the matter.
